The AI & Legal Update #9 - 💡 VPs, SBs, Fleece

AI Regulatory & Litigation

🗳️ Trump promises to revoke Biden’s AI executive order, which he calls dangerous. His AI plans, as outlined in the new Republican platform, seek to ‘make America first in AI’ and are influenced by Silicon Valley investors like Peter Thiel. Also interesting - VP pick JD Vance has spoken on AI and open source. Click to watch JD Vance clip below and you can also read GC AI's analysis of Vance's views.

Tweet clip of JD Vance testifying on AI, posted with 'The solution, of course, is open-source'

🤷 Meanwhile, AI says nobody won the presidential debate. Fair point given neither candidate used the word “AI”, and “tech” was mentioned only twice.

⛽ Re: Loper Bright/Chevron and AI

  • Justice Kagan says AI is “the next big piece of legislation on the horizon” that’ll face the absence of Chevron deference. “What Congress wants, we presume, is for people who actually know about AI to decide those questions,” Kagan said.

  • Rep. Don Beyer, D-Va. told FedScoop that the ruling “makes it much more important that Congress respond to AI with legislation…[J]udges and law clerks [have] no relevant expertise ...”

📖 California Draft AI Bill SB-1047 would regulate LLM providers and require certification to a newly formed regulatory wing.

  • Silicon Valley VC's take? Y Combinator says the bill would tank California's AI lead (summary), and Marc Andreessen warns, “you may not be interested in politics, but politics is interested in you,” and the firm launched a campaign against the bill.

  • Senator Weiner responded, saying A16z and YC's campaigns were “misleading”, “false”, “highly inflammatory distortions” and calling on them to put forth their own AI regulator proposals. We'll see.
